Release and Waiver of Liability | Camp N Trip Part 11 April 20 - April 24, 2023
In consideration of my participation at ATL Camp N Trip Part 11, I hereby agree to the following:
1. I waive and release ATL Camp N Trip and its officials, officers, employees, agents and volunteers from any and every liability of loss, including, but not limited to, liability or loss for damages or personal injury or property damage related to any claim that may be filed concerning, on behalf of, or for myself, either now or in the future, that results from or is connected in any way to my participation at ATL Camp N Trip. The waiver and release applies even if the liability or loss results or is connected with the active or passive negligence of ATL Camp N Trip and/or their officials, officers, employees, agents or volunteers.
2. I acknowledge that my participation at ATL Camp N Trip presents known and unanticipated risks that could result in physical injury, or damage to myself or my property. I understand that injury or loss may result from unknown or unexpected risks, but may also result from environmental conditions, from the acts or omissions of others, or from the unavailability of immediate and/or adequate emergency medical care. I hereby assume the risk of, and responsibility for any such injury, or damage which I or my property may sustain arising out of or in any way connected with my participation, including injury or damage resulting from any acts or omissions, whether negligent or not, by or on behalf of ATL Camp N Trip, their officials, officers, employees, agents or volunteers.
3. I understand that ATL Camp N Trip does not guarantee my personal health or safety at any point during the event, nor does it protect me against risk of loss of my personal property. I understand ATL Camp N Trip does not assume responsibility for the actions of others, for events that are not part of ATL Camp N Trip, or that are beyond the control of ATL Camp N Trip or its contractors, or for situations that may arise due to the failure of the participant to disclose pertinent information.
4. I agree not to sue and to indemnify, and to the fullest extent available by law, defend with counsel acceptable to ATL Camp N Trip and hold harmless ATL Camp N Trip and their officials, officers, employees, agents, and volunteers from and against any and all liability or loss, damage, claims, expenses and costs (including without limitation, attorneys' fees and costs and fees of litigation)(collectively "Liability"), related to any claim that may be filed concerning, on behalf of, or for myself and/or any other person or entity either now or in the future, that results from or is connected in any way with my participation at ATL Camp N Trip. In signing this agreement, I fully recognize that if anyone is hurt or dies, or property is damaged while ATL Camp N Trip, I will have no rights to make any claim or file a lawsuit against ATL Camp N Trip, their officials, officers, employees, agents, and volunteers. This agreement to not sue and to indemnify and hold harmless applies even if the liability of loss results from or is connected with the active or passive negligence of ATL Camp N Trip, their officials, officers, employees, agents or volunteers.
5. I consent to medical treatment in the event of injury, accident and/or illness during my participation at ATL Camp N Trip Part 11. I understand and acknowledge that no medical insurance benefits will be provided for injuries occurring while at ATL Camp N Trip Part 11. I certify that I have sufficient health, accident, and personal liability insurance to cover bodily, property damage, or any consequences resulting from my participation at ATL Camp N Trip Part 11. If I have no such insurance, I certify that I am capable of personally paying for any and all expenses or liability. I understand and agree that I will accept responsibility for any medical bills, including co-payments and deductibles. I further acknowledge that the undersigned is in good physical and mental health, not suffering from any condition, disease or disablement, which would or could potentially affect participation at ATL Camp N Trip Part 11.
6. “I” on behalf of myself and the occupants of my camping unit (meaning any physical unit located at event), hereby release and indemnify ATL Camp N Trip, their officials, officers, employees, agents or volunteers from any liability regarding me or anyone staying in my camping unit relating to COVID-19 and any other viruses or illnesses that we may get as a result of our participation at ATL Camp N Trip Part 11.
7. I agree any property will be considered abandoned, donated or unwanted if not removed at the conclusion of ATL Camp N Trip Part 11 and will become the property of ATL Camp N Trip.
8. USE OF NAME AND LIKENESS. I hereby grant to ATL Camp N Trip (“Company”) and its affiliates the right and permission to use in perpetuity, my name, likeness, image, voice, recorded voice, appearance, biographical information, statements, performance and/or testimonial(s) (collectively, “Appearance”) in any manner and in any media, now known or later developed, throughout the world, at any time, for the purpose of advertising and publicizing the COMPANY’s products and services, without review, permission or compensation of any amount or kind whatsoever. COMPANY shall have complete ownership of any recording, product, copy, presentation or other material or file containing or featuring my Appearance (“Product”) that is created on behalf of the COMPANY, including copyright interests, and I acknowledge I have no interest or ownership in the Product (or any portion thereof) or its copyright. This grant includes without limitation the right for COMPANY to edit, abridge, augment, title, or create a compilation from my Appearance in whole or part as COMPANY may elect in its sole discretion.
9. RIGHT TO CONTRACT. I am at least the age of 18yrs old and have the right and the ability to enter into this agreement.
10. RELEASE OF LIABILITY. I shall not hold COMPANY responsible for any liability resulting from the lawful use of my Appearance in accordance with the terms of this agreement.
11. This release and waiver of liability will bind me, and my heirs, successors, and assigns, and shall remain in effect so long as ATL Camp N Trip is in existence. I understand and acknowledge that by signing this agreement I have given up certain legal rights and/or possible claims which I might otherwise assert or maintain against ATL Camp N Trip Part 11, their officials, officers, employees, agents or volunteers including but not limited to rights arising from or claims for the acts or omissions, fault or negligence of ATL Camp N Trip, their officials, officers, employees, agents or volunteers. I understand and acknowledge that by signing this agreement, I have assumed responsibility and LEGAL LIABILITY for the claims or other legal demands, including defense costs, which may be asserted by third parties against myself as a result of my participation at ATL Camp N Trip Part 11.
12. This release and waiver of liability is intended to be as broad and inclusive as permitted by the laws of the State of Georgia, in the United States of America, and that this release shall be governed by and interpreted in accordance with the laws of the State of Georgia. If any portion of this release and waiver of liability is determined by a court to be invalid, the rest of the release and waiver of liability will continue in effect.
13. I understand that this constitutes the entire agreement between undersigned ("Myself") and ATL Camp N Trip, their officials, officers, employees, agents or volunteers and that it cannot be modified or changed in any way. This Waiver and Release is a Georgia contract and I consent to the jurisdiction and venue for any action relating to this Waiver and Release in Atlanta, Georgia regardless of my residence or domicile.
I HAVE CAREFULLY READ THIS RELEASE AND WAIVER AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE AND WAIVER OF LIABILITY BETWEEN MYSELF AND ATL CAMP N TRIP IN FAIRBURN, GEORGIA. I SIGN IT FREELY AND VOLUNTARILY AND AGREE TO BE BOUND BY IT’S TERMS.
